1. The following are the general Terms and Conditions (“T&C”) that apply to all aspects of using our website, uccmarket.com, hereinafter referred to as “our website.” These T&C also apply to investors’ and traders’ accounts and digital products and services operated by AGOROM GLOBAL LIMITED COMPANY (uccmarket.com) through our website and traders’ outlets.
   
2. All products traded on Uccmarket.com are digital, and therefore, Uccmarket is not obligated to provide any physical representation of the products offered on the website.
3. Uccmarket.com offers its digital product trading through various channels and methods, including but not limited to the website and app, collectively referred to as “The service.”
4. By using the service, you agree to these General Terms & Conditions, along with any other terms and conditions that may be applicable for a specific type of service or product made available on the system, trading rules, terms and conditions applicable to bonus promotions, rewards programs, special offers, or any other promotions on our website.
5. All the terms and conditions listed here are collectively referred to as “the Terms of Use.” “User,” “Trader,” “You,” and “Your” refer to the person accessing the Service and accepting the Company’s terms and conditions. Whenever you use the service, such as placing a trade or participating in any promotions offered, you agree to be bound by the Terms of Use, including any amendments that may periodically take place.
6. These Terms and Conditions represent the complete, final, and exclusive agreement between you (the Trader) and the Company, superseding all prior agreements, representations, and understandings.
7. By using our service, you confirm that you have reached the age of 18 or the legal age required for online trading under the laws applicable to you. However, Uccmarket does not accept users under the age of 18 or applications from any form of incorporated or unincorporated legal entity. Uccmarket reserves the right to verify your age and status and may exclude you from its services if there are doubts regarding your age or identity. If any underage Trader is identified or found to have registered with false information, their earnings will be forfeited, and their account will be blocked immediately.
8. Uccmarket does not guarantee constant availability and functionality of all products offered on uccmarket.com or its applicable app or channels. Uccmarket will not be liable for any damages, losses, costs, loss of profits, or any other disadvantage a Trader may incur due to disconnection from or non-availability of any of the products offered by Uccmarket for any reason.
9. Uccmarket shall not be liable for any damage or loss caused directly or indirectly by the service, its contents, or contents provided by third parties, unless it is based on intentional or gross negligence.
10. Uccmarket shall not be liable if the Trader is unable to place a trade or place a stake due to congestion on the server network system or any other electronic communication media used for Trading purposes.
11. All indicated dates and times are based on WAT (West Africa Time) unless stated otherwise.
12. Any exceptions to the existing Terms of Use will be communicated in written form to the Trader. Verbal statements made by Uccmarket employees or affiliates will not be considered in case of a dispute.
13. The Trading contract and any other legal relationship between the Trader and the Company, not regulated by the Terms of Use, are subject to Nigerian laws.
14. Please carefully read these General Terms and Conditions before using any section of our Website. By using any section of our Website and/or registering an Account, you agree to be bound by these Terms & Conditions.

ACCESS AND USE OF UCCMARKET.COM AND THE SERVICES & PRODUCTS.

1. Uccmarket does not guarantee constant availability and functionality of our Website or any Services. We reserve the right to withdraw, suspend, or modify any aspect or feature of our Website and/or any Service without prior notice. Additionally, Uccmarket may, at its absolute discretion, change the content of our Website or the Services, including trading products or elements, at any time.
2. You may only use our Website and Services for personal, non-commercial purposes. Reproduction of our Website or any part of it in any form or creating links suggesting association, approval, sponsorship, or endorsement without Uccmarket’s express written consent is not permitted.
3. Our Website may contain links to other websites provided by third parties, which are for informational purposes only. We have no control over the contents of these external sites and do not accept responsibility for any loss or damage arising from their use or the information they may acquire about you (including personal data). The inclusion of any such link does not constitute an endorsement by Uccmarket.
4. Your use of our Website, Account, and Services must comply with all applicable laws, statutes, and regulations. You must not misuse our Website by introducing viruses, trojans, worms, or any malicious material. Unauthorized access to our Website or Services is prohibited. Distribution or commercial exploitation of any Information or Data accessed via the Website is strictly prohibited.
5. You are responsible for ensuring access to our Website and Services. We cannot guarantee compatibility with your hardware or software. Some Services may require software downloads, which we may license to you for use solely in utilizing the Services. Any material downloaded or obtained through our Website is at your own risk, and we are not liable for any failures or issues arising due to disconnection or unavailability of Services or our Website.
6. The use of software made available via our Website is permitted solely for the purpose of using the products on our Website. The software is the exclusive property of Uccmarket or its licensors and is protected by applicable law. Your use of the software does not grant you any ownership of intellectual property rights in the software.
7. The right to access and use our Website and/or Services may be illegal in certain countries. You are responsible for determining compliance with applicable laws in your jurisdiction. The Website and Services do not constitute an offer or invitation for use in countries where such activities are illegal. Users must ensure legal compliance in their country of access.
8. If you use our Services from outside Nigeria, compliance with exchange control regulations and foreign jurisdiction laws is your responsibility. Uccmarket will not be liable for any failure to remit funds to accounts in foreign jurisdictions.
9. The product trading service execution is exclusively in USD (United States Dollar).

MANAGING TRADERS ACCOUNT

1. To access the services and products offered by Uccmarket, each Trader must open a Trading Account. By opening an Uccmarket account and placing trades or staking, the Trader confirms that they have reached the minimum legal age required for participation and have the legal capacity to enter into an agreement with the Company. Failure to meet these conditions will result in the closure of the Trader’s account and other necessary measures.
2. It is the responsibility of the Trader to ensure that accessing and using our Website and services comply with applicable laws in their jurisdiction, and they confirm that online trading is legal in their territory. Uccmarket does not offer its services in countries where online trading is deemed illegal.
3. Traders are prohibited from buying, selling, or transferring accounts to other Traders without notifying the company.
4. When a new account is opened, the Trader is responsible for providing accurate and up-to-date personal information and contact details. Uccmarket reserves the right to close accounts if the information provided is found to be false or inaccurate.
5. Personal data is stored in the company’s database and will not be shared with third parties, except as stated in the Privacy Policy. Uccmarket may relay suspected offender’s details to regulatory bodies, authorities, or third parties investigating offenses related to match or price manipulation.
6. Each Trader may have only one account with Uccmarket. The company retains the right to close the account of any Trader who has opened multiple accounts under their name or different names. If multiple accounts are suspected to be opened with the intention of defrauding the company, any related transactions may be canceled.
7. After opening an account, the Trader must keep their username, password, and/or account number confidential. All transactions using the correct credentials will be considered valid, whether or not authorized by the registered account holder. The company will not be liable for any claims if the Trader discloses or loses their login information.
8. Traders can request the closure of their account by contacting Customer Service in writing. The account closure will mark the termination of the Terms of Use.
9. Personal details stored in the system will be deleted upon the Trader’s express request after the legal period of warranty, which is typically seven (7) years.
10. A closed account may be reopened upon request and approval by the Company, subject to the current Terms of Use.
11. Uccmarket reserves the right to exclude Users from its services at its discretion. In such cases, the residual credit balance in the account will be refunded using the same payment method provided during registration or any other payment methods verified subsequently. If the account was closed due to an infringement of the Terms of Use or prohibited behavior, resulting in collusion, fraud, or criminal activity, the residual credit balance may be forfeited. The same procedure applies to open trades that result in profit.
12. If a Trader does not access their account by logging in for a period of six calendar months, the account will be considered “Inactive.”

Section E.

DEPOSITS AND WITHDRAWALS ON THE SYSTEM.

1. You can deposit funds into your Trading Account using the payment methods made available by Uccmarket. We may verify the ownership of the payment method(s) used to credit your Account and may request supporting evidence from you. If you deposit funds using a payment method not registered in your name, we may suspend your Account and request additional information to confirm your authorization to use the payment method. Your Account may remain suspended until the requested information is provided and verified. Any bank account registered under your Account must be operated by a Nigerian licensed bank and registered in your name only.
2. Uccmarket does not charge fees for deposits made by bank transfers, USDT, credit, or debit cards; however, payment providers’ charges may apply. The minimum and maximum deposit amounts may vary based on the chosen payment method, and your trades can only be executed up to the available balance on your Account, subject to applicable minimum and maximum limits.
3. Your Account is intended solely for using the Services and should not be used as a banking facility. Deposits should be made with the intention of using the funds for trading purposes. We reserve the right to suspend or restrict your Account if we suspect any improper activity related to depositing or withdrawing money without genuine trading. In such cases, we may terminate the Account and offset any bank charges incurred from your Account balance without prior notice.
4. Uccmarket may change the accepted payment methods from time to time and may refuse to accept certain payment methods at our discretion, without providing reasons.
5. You can withdraw the available cash balance of your Account, including profits earned from trades, by making a withdrawal request. Withdrawals can be made into a bank account registered under your name or a USDT wallet.
6. Uccmarket cannot recover cryptocurrency (USDT) payments, so it is your responsibility to ensure that the provided USDT wallet address is correct. Any payment made to the provided USDT wallet address cannot be reversed.
7. During withdrawals, you must provide an account number bearing your registered name on Uccmarket.com; otherwise, your request will be rejected. We charge withdrawal fees, which will be displayed to users before completing a withdrawal request. These charges are subject to change with or without prior notification.
8. Uccmarket may reject any withdrawal request if it appears to be linked to transactions primarily performed to transfer money between payment methods or in the case of untraded deposits and withdrawals without satisfactory evidence of payment method ownership.
9. Verification checks may be conducted during withdrawal, as required by Uccmarket or third parties, and the availability of withdrawal methods or the withdrawal function may be suspended until verification is completed.
10. You may be asked to provide various documents for verification purposes, such as ID copies, credit card copies (showing the last 4 digits only), bank statements, and any relevant document required to complete the check. Your cooperation with these requests will expedite the verification process.
11. Withdrawals are generally processed within 48 working hours, subject to the verification process, and any delays related to payment providers are not Uccmarket’s liability.
12. Charge backs, reversals, or cancellation of any deposit previously made into the Account are not allowed. If we incur any charge backs or reversals, we reserve the right to charge you or set off the relevant amounts incurred from your Account balance.
13. We reserve the right to withhold payment and cancel trades if we believe you have breached the Terms of Use, including placing trades under the age of 18, using the Services in an illegal jurisdiction, or receiving deposits or withdrawals from another person’s Account. If you owe us any money, we may offset the amount owed against money in your Account before making further payments or withdrawals.
14. You are responsible for reporting your profits to the appropriate tax or other authorities, as applicable.

Section F (i a).

PRODUCT OFFERS – PLACING A TRADE

1. You acknowledge that Uccmarket has the right to accept or decline any trade and may also discontinue or limit any product on the platform with or without notifications. In case of product discontinuation, all orders for that product will be canceled, and traders will receive their capital back, along with or without profits, depending on the reason for the product cancellation.
2. You understand and accept that you may lose your capital or a percentage of it if you manually sell or use the AI-Robot to automatically sell a purchased product at a value lower than your initial purchase value.
3. Uccmarket has the right to add more trading products to the platform with or without notifications at any time, which may increase or decrease the available products in the market.
4. You accept the functionality of Uccmarket’s system, where you can earn a profit by purchasing a product at a stipulated price value and selling it at a higher value, making the difference between your initial purchase value and the selling value your profit.
5. You also accept the risk of losing your capital if the market goes against your purchased value, and you decide to sell the product at a loss, in which case you will lose the current purchase value from your already traded value.
6. You acknowledge that all traded products on Uccmarkets are digital products, and the platform has no obligation to provide physical products to investors.
7. You agree to accept the market value and price change factors of the traded products at the time of your trade (Buy) and at the time of closing your trade (Sell).
8. In the case of Auto take profit and auto sell (end) Trade, you agree to the system’s automated execution based on your provided configurations, which may result in a profit or loss of your capital.
9. You must have sufficient funds in your Account to place a trade, and all trades are subject to the minimum trade amount requirement. You are responsible for reviewing and understanding the Terms of Use and any specific terms of trading or trading applicable to your chosen Service or product.
10. All trades are subject to the maximum payout limit, which may change. Once your trade is accepted by Uccmarket’s server, it will be deemed valid, and you cannot cancel or change it.
11. Uccmarket charges fees based on the sold product value, and the charges amount or percentage is subject to change with or without notifications.
12. Uccmarket is not responsible for settling any trades that are not Accepted Trades or for invalid trades. The earnings due on valid trades made from the cash balance of your Account will be added to your Account balance once settled. This balance will remain on your Account unless you submit a request for withdrawal.

PRODUCT OFFERS – PLACING A STAKE

1. Acknowledgment of Staking System: By using the staking system on UCCMarket as a gaming offer, you recognize that there is a 50/50 earning probability associated with it.
2. Potential Loss of Stake Capital: You acknowledge that participating in the staking system may result in the complete loss of your stake capital if your predicted outcome or selected winner does not align with the actual outcome.
3. Responsible Promotion: You agree not to promote the staking system to other customers without adequately informing them of the potential risk of losing their stake capital. Using referral links or promo codes to attract users to the staking system implies that you have educated them on how the staking system operates.
4. UCCMarket’s Right to Modify Staking Parameters: You acknowledge that UCCMarket reserves the right to edit or modify the minimum stake amount, minimum stake product, maximum stake amount, and maximum stake product with or without prior notice to customers, as deemed necessary.
5. Suspension of Services: UCCMarket retains the right to withhold, pause, or stop the staking services at any time, with or without prior notification. In such cases, all ongoing stakes will be canceled, and funds will be returned to customers.
6. System Failure Disclaimer: UCCMarket shall not be held responsible if your stake incurs losses due to system failures, which may be caused by bad network conditions or slow server response times.
7. Staking with Different Stake IDs: You acknowledge that staking with someone else’s stake ID, whether it is a running ticket, loss ticket, or won ticket, will load the same stake product with a different start time frame.
8. Outcome Determination: UCCMarket has no control over the operation of the staking system, and your winning or losing is determined by the product market’s demand and supply.

Market Movement And History.

1. Uccmarket retains the authority to periodically clear past market history on a monthly or yearly basis to ensure the safety of its database and facilitate seamless service operations. Rest assured that any open product histories (unsold items) will be safeguarded, and we will not delete them.
2. The price value of digital market products on Uccmarket varies depending on several factors, primarily influenced by the demand and supply dynamics. These fluctuations are a significant determinant of the product’s price, which can be either high or low over short or extended periods. Importantly, the pricing is not manually controlled but is subject to market forces.

Section F (iii).

KYC Documentations

1. To utilize the withdrawal of funds and access other advanced services on our trading system, every trader on Uccmarket must verify their trading account.
2. Once an account has been verified, traders will no longer have the ability to personally or manually edit their trading information. To update account details, traders must contact the Uccmarket team and provide both the old and new verification documents for assistance.
3. Uccmarket retains the right to reject or request a re-submission of your KYC verification request if the submitted details fail to meet our verification requirements or if we find a reason to reject the request or ask for new documents.

Section G.

AI-ROBOT AUTOMATED TRADE

1. We may provide the option to use an AI-Robot on our website and app to sell already purchased products for potential profit or loss of capital.
2. You acknowledge and accept full responsibility for any actions taken by your AI-Robot at any time, whether they result in profits or a loss of your capital.
3. You agree to the terms that only allow the AI-Robot to sell your purchased products on your behalf when manually configured by you on your account. The AI-Robot cannot buy products on your behalf.
4. You are the sole user with full rights to your account and AI-Robot, and any configurations executed by your AI-Robot are solely your responsibility.

BONUSES & PROMOTIONS.

1. We may offer bonus offers, promotions, or reward programs on our website. You can find more information about these offers on the website, in your Account, or on our help or blog pages.
2. Your eligibility for any offer or promotion, as well as participation in the rewards program, will be subject to the terms and conditions specified for each respective bonus offer, promotion, or rewards program, which are available on the website at all times.
3. Uccmarket reserves the right to deny admission or terminate participation in any bonuses, promotions, and/or special offerings. Additionally, we may modify, suspend, or discontinue their validity at our sole discretion and without prior notice.
4. Having a UCCMarket promo code does not grant you partnership with the company, and Uccmarket reserves the right to withdraw your promo code at any time if necessary.
5. Users with no initial deposit history or who have not made any initial deposit on the system are not eligible to use promo codes or make fresh deposits using promo codes. Promo codes can only be used by users with an existing deposit history or users who have made deposits before on the system.
6. The referral up-liner is only eligible to earn a referral deposit bonus from the initial deposit of their referral and will not earn any other bonus on subsequent deposits.
7. You agree not to use your promo code for personal or same account deposits, and we reserve the right to deactivate your promo code if you fail to comply with these rules.

2. Please note that each user is subject to daily withdrawal limits and transaction limits set by Uccmarket. These limits are in place to ensure the smooth functioning, regulatory purposes and security of the platform.

Section I.

ERRORS AND OMISSIONS ON UCCMARKET

1. Uccmarket strives to maintain accurate and error-free systems for the Website and Services. However, in certain instances, human or system errors may occur. In such cases, Uccmarket reserves the right to rectify any error and cancel any trade or stake affected by the error.
2. Errors may arise due to various circumstances, including but not limited to: (i) Incorrect prices or terms offered for a product at the time of trade or stake placement; (ii) Fraudulent or prohibited activity by the user in breach of the Terms of Use; (iii) Failure to comply with the relevant terms and conditions of the Services; (iv) Mistakes in the calculation of profits/returns; (v) Incompatible values accepted in a trade due to technical errors; (vi) System or communication failures related to product market value generation.
3. Uccmarket has the following options to handle errors: (a) Correct the error and re-settle the trade at the correct price or terms available on the Website at the time of trade placement. (b) If correction is not practicable, cancel the trade and return the traded amount to the user’s Account. (c) In cases of fraudulent or prohibited activity, cancel the trade and terminate the user’s Account.
4. If Uccmarket wrongly pays an amount to the user or overpays, the user agrees to repay the overpaid amount upon request. The user must inform Uccmarket of any wrongly credited amount promptly. Uccmarket may adjust the user’s Account to rectify the error and may withhold any profits received with such funds.
5. Neither Uccmarket nor its partners or suppliers shall be liable for any loss, including loss of profits, resulting from any error or mistake made by the user in utilizing the Services.
6. If the user becomes aware of any error, they must inform Uccmarket immediately and cease further activity related to the affected Service(s).
7. In case of any dispute, the records of Uccmarket’s server shall act as the final authority in determining the outcome.
8. Please report any errors or seek clarification by contacting the Customer Support Team. Telephone calls to the support team may be monitored or recorded for training and quality purposes. In the event of any discrepancies between the printed and web versions of a document or trade, the web version shall prevail.

NO WARRANTY

1. Uccmarket aims to provide the Website and Services with reasonable skill and care. However, we do not make any additional warranty or representation, whether express or implied, regarding the Website and Services. All implied warranties or conditions of satisfactory quality, fitness for a particular purpose, completeness, or accuracy are excluded to the fullest extent permitted by law.
2. We do not provide any warranty for the uninterrupted provision of Information or Data through the Website or any part of it, its accuracy, or the results obtained through its use. The Information or Data on the Website is for informational purposes only and should not be considered as advice or recommendations. Trading decisions made based on this information are done at your own risk and discretion.
3. Uccmarket does not guarantee that the Website and Services will meet your specific requirements, be uninterrupted, timely, secure, or free from errors. We do not guarantee that any defects will be corrected, or that the Website or server hosting it, or the Services, are free from viruses or bugs. We do not guarantee the full functionality, accuracy, or reliability of materials or the accuracy of information obtained through the Website.
4. Trading and using the Website and Services involve inherent risks, and any decision or action taken based on the information provided is solely your responsibility. Uccmarket shall not be held liable for any losses, damages, or consequences resulting from your use of the Website or Services.

Section K.

LIMITATIONS OF LIABILITY

1. You acknowledge and agree that your use of the Website and any of the Services is at your own risk, and Uccmarket shall not be held liable for any damages, liabilities, or losses of any kind arising from or related to the Website, its content, the Account, and/or any of the Services. This includes but is not limited to delays or interruptions in operation or transmission, communication or lines failure, any misuse of the Website, the Account, and/or the Services by any person, or any Error.
2. Uccmarket shall not be liable for any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of business, loss of profits, loss of revenue, loss of data, loss of opportunity, loss of goodwill or reputation, or any other similar losses, arising out of or in relation to your use of the Website, the Services, any activity under the Account, and these Terms of Use. This limitation of liability applies even if such losses are foreseeable or if Uccmarket has been advised of the possibility of such losses.
3. We shall not be liable for any loss of content or material uploaded or transmitted through the Website and/or the Account, or otherwise transmitted to us.
4. Uccmarket reserves the right to modify, suspend, or discontinue the Services or any part of them without any liability whatsoever.
5. Furthermore, we shall not be liable for any loss or damage that you may suffer due to circumstances beyond our control, including but not limited to acts of God, power failure, trade or labor disputes, acts or omissions of any governmental authority, obstruction of telecommunication services or networks, or any other acts or omissions caused by a third party or events beyond our control.
6. Our maximum liability to you arising out of the Terms of Use, whether for breach of contract, tort (including negligence), or otherwise, will be limited to the amount of the trade relevant to which the liability has arisen. In the event that funds paid by you into your Account have been misplaced by us, our liability will be limited to returning the same amount into your Account.
7. Nothing in the Terms of Use shall exclude or limit Uccmarket’s liability for liability that cannot be excluded by applicable law.
8. It is important to note that trading involves risks, and you should carefully consider your decisions and actions while using the Website and Services. Uccmarket shall not be responsible for any losses or damages resulting from your trading activities. Always trade responsibly and be aware of the risks involved.

Section N.

COMPLAINTS AND CLAIMS

1. All complaints regarding trades placed through the Services must be communicated to Uccmarket within 48 hours from the date of the ending of the trade or, if the trade is still pending, from the date of acceptance of the trade. You can address your complaints to the Support Services team and include your Account Username and the details of the trade.
2. While your complaint is being investigated and resolved, Uccmarket reserves the right to suspend the Account and/or refuse the acceptance of any trade, and/or withhold or withdraw any promotional offers under your Account.
3. It is essential to maintain a respectful and professional demeanor while contacting our staff or discussing our products and services in any media, network, or forum. Offensive, rude, malicious, or damaging comments will not be tolerated. Any violation of this policy may result in the suspension or termination of the Account, and other appropriate remedies or actions may be taken as permitted by law. We expect all users to engage in constructive and respectful communication when dealing with our support team or interacting within our community.

Section N (I).

SEVERABILITY

If any provision of the Terms of Use is found to be invalid or unenforceable by any court or administrative body of competent jurisdiction, it will not affect the validity or enforceability of the other provisions of the Terms of Use, which shall remain in full force and effect. In such instances, the part declared invalid or unenforceable will be amended in a manner consistent with the applicable law to reflect, as closely as possible, Uccmarket’s original intent. The rest of the Terms of Use will continue to be valid and enforceable.

Section N (II).

RELATIONSHIP AND THIRD PARTY RIGHTS

1. The Terms of Use shall not create or be deemed to create a partnership, joint venture, or principal-agent relationship between the User and Uccmarket. The relationship between the User and Uccmarket is solely that of a user and a service provider.
2. Unless expressly stated in the Terms of Use, no provision in the Terms of Use shall create or confer any rights or benefits on any person other than you and Uccmarket. The rights and obligations under the Terms of Use are limited to the User and Uccmarket, and no third party shall have any enforceable rights under these terms.

Section N (III).

APPLICABLE LAW AND PLACE OF JURISDICTION

1. These Terms of Use shall be governed by and interpreted in accordance with the laws of Nigeria. By using the Uccmarket website and services, you agree to submit to the non-exclusive jurisdiction of the courts of Nigeria in relation to any dispute arising from or related to these Terms of Use.
2. Any trade placed by the User shall be governed by the applicable provisions of the Nigeria Criminal Code Act, CAP. 22, and any regulations and rules made in terms thereof, as amended from time to time. It is the responsibility of the User to ensure that they are aware of and comply with these provisions while using the Uccmarket services.

TERMINATION

Uccmarket reserves the prerogative to temporarily suspend or permanently terminate the provision of trading services to a User without the obligation to provide any explanation before accepting any trade.
